1. Agreement to Terms
By engaging Arcwright's watch repair services, visiting our website, or communicating with us regarding potential services, you agree to be bound by these Terms & Conditions. Please read them carefully before proceeding with any service.
If you do not agree with any part of these terms, please do not use our services. These terms constitute a legally binding agreement between you and Arcwright.
2. Definitions
For the purposes of these Terms & Conditions:
- "We," "Us," "Our" refers to Arcwright, a watch repair business located in Taichung, Taiwan
- "You," "Your," "Client" refers to the individual or entity engaging our services
- "Services" refers to watch repair, restoration, timing optimization, and related watchmaking services
- "Timepiece" or "Watch" refers to any mechanical or automatic watch submitted to us for service
- "Service Agreement" refers to the specific terms agreed upon for each individual watch repair
3. Service Description
Arcwright provides professional watch repair and restoration services, including but not limited to:
- Timing optimization and regulation adjustments
- Complete movement restoration and overhaul
- Component cleaning, lubrication, and replacement
- Diagnostic evaluation and consultation
- Creation and maintenance of service records
Specific services are determined through consultation and documented in a Service Agreement before work begins.
4. Service Process
4.1 Initial Consultation
Before accepting any watch for service, we conduct an initial evaluation to determine the appropriate service and provide an estimate of cost and timeline.
4.2 Service Authorization
Work begins only after you approve the recommended service and estimated cost. Your authorization may be provided in person, via email, or by phone.
4.3 Additional Work
If we discover additional issues during service that require attention, we will contact you for approval before proceeding with any work beyond the original Service Agreement.
4.4 Completion and Pickup
Upon completion, we will notify you that your watch is ready for pickup. Watches must be collected within 90 days of notification.
5. Pricing and Payment
5.1 Service Fees
Our standard service fees are listed on our website and during consultation. Pricing may vary based on movement complexity, required parts, and specific conditions discovered during service.
5.2 Parts and Materials
Replacement parts are billed separately from labor. Part costs are disclosed before installation, and you may choose to approve or decline specific replacements.
5.3 Payment Terms
Payment is due in full upon completion of service and before the watch is returned to you. We accept cash and major credit cards. All prices are in New Taiwan Dollars (NT$).
5.4 Deposits
For services exceeding NT$30,000 or requiring special parts orders, we may require a deposit of up to 50% before beginning work.
6. Timelines and Service Duration
Service timelines are estimates based on typical conditions. Actual completion time may vary due to:
- Parts availability and shipping delays
- Discovery of additional issues requiring attention
- Movement complexity or unusual caliber characteristics
- Necessary monitoring periods for quality assurance
We will inform you of any significant delays as soon as we become aware of them.
7. Client Responsibilities
7.1 Accurate Information
You agree to provide accurate information about your watch's history, any previous repairs, and known issues. Withholding relevant information may affect our ability to properly service the watch.
7.2 Proof of Ownership
We reserve the right to request proof of ownership for valuable timepieces. This protects both you and us from potential issues with stolen property.
7.3 Timely Communication
You agree to respond to our communications regarding your service in a reasonable timeframe, particularly when decisions about additional work or part replacements are needed.
8. Workmanship Assurance
8.1 Coverage
We provide a one-year assurance on our workmanship from the date of service completion. This covers defects or failures directly related to the work we performed.
8.2 Exclusions
Our workmanship assurance does not cover:
- Pre-existing conditions not addressed during service
- Normal wear and tear after service
- Damage from accidents, misuse, or improper handling
- Water damage if water resistance was not tested or if the watch was exposed beyond its rated depth
- Issues arising from unauthorized repairs by other parties
- Problems with components we specifically advised you to replace but you declined
8.3 Remedy
If a defect covered by our workmanship assurance occurs, we will correct the issue at no additional charge. This is our sole obligation under the assurance.
9. Limitation of Liability
9.1 Inherent Risks
You acknowledge that watch repair involves inherent risks, including the possibility of damage to aged components, discovery of hidden defects, or complications arising from previous unauthorized repairs.
9.2 Liability Cap
To the fullest extent permitted by Taiwan law, our total liability for any claim related to our services is limited to the amount you paid for the specific service in question.
9.3 Consequential Damages
We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, sentimental value, or business interruption.
9.4 Insurance Recommendation
For particularly valuable timepieces, we recommend you maintain appropriate insurance coverage. We maintain insurance for watches in our care, but coverage is limited.
10. Uncollected Watches
Watches must be collected within 90 days of notification that service is complete. After 90 days:
- A storage fee of NT$200 per month will be charged
- After 180 days, we may exercise our legal right to dispose of uncollected property to recover storage and service costs
- We will make reasonable efforts to contact you before disposing of any property
11. Intellectual Property
All content on our website, including text, images, service documentation formats, and proprietary processes, is protected by copyright and remains the property of Arcwright.
Service records we create for your watches are provided to you for your reference but remain our intellectual property. You may not reproduce or commercially exploit these materials without permission.
12. Privacy and Data Protection
Your personal information is collected and processed in accordance with our Privacy Policy and Taiwan's Personal Data Protection Act. Please review our Privacy Policy for details on how we handle your information.
13. Dispute Resolution
13.1 Good Faith Negotiation
In the event of any disagreement or dispute, we encourage you to contact us directly so we can attempt to resolve the matter through good faith discussion.
13.2 Governing Law
These Terms & Conditions are governed by the laws of Taiwan, without regard to conflict of law principles.
13.3 Jurisdiction
Any legal disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Taichung City, Taiwan.
14. Cancellation and Refunds
14.1 Before Work Begins
You may cancel a service before we begin work with no penalty. Any deposits will be refunded in full.
14.2 After Work Begins
If you wish to cancel after work has begun, you will be responsible for payment for work completed up to the cancellation point, plus any parts already ordered.
14.3 Our Right to Refuse
We reserve the right to refuse service or discontinue work if we determine the watch cannot be safely or properly serviced, or if continuing would require methods or resources we don't possess.
15. Modifications to Terms
We may update these Terms & Conditions periodically. Changes become effective upon posting to our website with a new "Last Updated" date.
Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We will make reasonable efforts to notify clients of significant changes.
16. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms & Conditions, together with any Service Agreement for your specific watch and our Privacy Policy, constitute the entire agreement between you and Arcwright regarding our services.
